These Terms of Service govern the relationship between users and the organization when accessing services, resources, or content provided through the website or by engagement. By using the services, users acknowledge acceptance of these terms and any additional terms referenced herein. If a user does not accept these terms, they should not use or access the services.
Acceptance of Terms
Use of services implies agreement to these Terms of Service and any future revisions. The organization may require explicit written or electronic acceptance for certain services. Separate contractual agreements may supplement these terms, and where applicable, specific project agreements will prevail to the extent of any conflict.
Use of Services
Users agree to use the services only for lawful purposes and in a manner consistent with applicable laws and regulations. Prohibited conduct includes submitting unlawful content, attempting to access restricted areas, engaging in activities that disrupt service operation, or using the service to infringe upon third-party rights. The organization reserves the right to suspend or limit service access for misuse or suspicious activity.
Intellectual Property
All intellectual property created by the organization during the course of providing services—unless otherwise specified in a separate agreement—remains the property of the organization until rights are transferred in writing. Users are granted limited, non-exclusive licenses to use deliverables for the intended business purposes outlined in engagement documents. Third-party materials incorporated into deliverables are subject to the respective third-party terms and licenses.
Limitation of Liability
The organization’s liability for any claim arising under these terms is limited to direct damages up to the amount paid for the specific services giving rise to the claim, except where prohibited by law. The organization is not liable for consequential, incidental, indirect, or punitive damages, lost profits, or loss of data arising from service use or inability to use the service. These limitations apply regardless of the legal theory asserted, to the fullest extent permitted by law.
Termination
Either party may terminate an engagement in accordance with the termination provisions set out in the relevant project agreement. In absence of a separate agreement, the organization may terminate service access at any time for cause, including payment default or breach of these terms. Upon termination, users must cease use of proprietary materials and return or destroy confidential information as required. Fees for work performed up to termination are payable, and certain post-termination obligations may survive.
Changes to Terms
The organization may revise these Terms of Service from time to time. Notice of material changes will be provided through the website or other communication methods used with existing clients. Continued use of services following notice constitutes acceptance of the updated terms. Users who do not accept the revised terms should stop using the services and notify the organization if applicable.
